This Refund Policy explains Accelerated Product Designs’ approach to refunds, rework, and remedies for consulting, engineering, and prototyping services. By engaging our services, signing a Statement of Work (SOW), or paying a deposit you agree to the terms below.
Scope
This Policy applies to all services provided by Mauricio Lastres doing business as Accelerated Product Designs, including feasibility sprints, prototype design and build, alpha/pilot work, consulting, retainers, prepaid blocks, and any related deliverables.

If a client reasonably demonstrates that Deliverables materially fail to meet the acceptance criteria set out in the SOW, Provider will offer rework or other remedies as described below.

Any statutory consumer rights are unaffected.
No general refunds for labor

All fees paid for consulting, design, engineering, and project management (hourly or fixed‑price) are non‑refundable once work has commenced or the deposit has been paid to reserve schedule.

Deposits are taken to reserve Provider’s time and scheduling and are not refundable except as described in a signed SOW or as required by law.
Physical prototypes and materials

Prototypes, mockups, jigs, test fixtures, and one‑off artifacts are delivered “as built” and intended for evaluation, fit, form, function, or test only. They are not production parts and are not warranted for extended use or durability beyond the stated test objectives.

Prototype refunds are not offered based on expected longevity or performance beyond the scope of the agreed test plan. Replacement or rework may be offered at Provider’s discretion and may be chargeable.
Acceptance, defects, and rework

Each SOW will describe acceptance criteria or a test/acceptance window. Client must notify Provider of any claimed nonconformance within the acceptance period specified in the SOW.

If Deliverables materially fail to meet the mutually agreed acceptance criteria, Provider’s obligation is to correct the deficiencies (rework) within a reasonable time at no additional charge, provided Client has paid all invoiced amounts and the deficiency is due to Provider error.

Rework does not include design changes requested after acceptance, changes in scope, misuse of Deliverables by Client or third parties, or defects arising from Client‑supplied materials or information. Such work will be quoted and billed separately.
Cancellation and partially completed work

If Client cancels a project after work has begun, Client remains responsible for all fees for work performed, and for any non‑cancellable third‑party costs incurred through the cancellation date. Provider will invoice for completed work and pass‑through costs; those invoices are due per the SOW terms.

Provider may, at its discretion, offer a partial credit in limited circumstances; any credit is subject to mutual written agreement.
Refunds for prepaid blocks and retainers

Prepaid hour blocks are a reservation of Provider time. Unused prepaid hours are generally non‑refundable but may be transferable or valid for a period defined in the SOW (commonly 12 months) if agreed in writing.

Monthly retainers are non‑refundable for the billing period once services for that period have been made available.
Royalty and revenue‑linked engagements

Royalty agreements, buyouts, and revenue‑share arrangements are governed by their specific agreement terms. Refunds of royalties or revenue shares are not available; disputes are resolved per the contract terms.
Remedies are limited

Provider’s liability and remedies related to refunds, rework, and Deliverable defects are subject to the limits and disclaimers set forth in the Master Services Agreement, SOW, and Terms and Conditions, including limitation of liability and indemnity provisions.
Exceptions and statutory rights

This Policy does not modify or waive any consumer rights or statutory protections that cannot lawfully be excluded in a client’s jurisdiction. If local law requires refunds or additional remedies, those local rules govern.
Dispute process

For any dispute about Deliverables, quality, or refund requests, contact: mauricio@acceleratedproductdesigns.com with a detailed description, supporting files, and the SOW reference. Provider will acknowledge and respond within 7 business days and seek good‑faith resolution, which may include documented rework, credits, or escalation per the SOW dispute terms.
How to request a review or rework

Send an email to mauricio@acceleratedproductdesigns.com with: SOW number, project name, description of the issue, and relevant files or photos.

Provider will confirm receipt and outline next steps, timeline for assessment, and proposed remedy if applicable.

If rework is agreed, Provider and Client will document scope, timeline, and whether any additional fees apply.
